These Terms of Use ("Terms") govern your access to and use of the VÄLR IQ mobile application ("VÄLR IQ," the "App," "we," "us," or "our"). By downloading, accessing, or using VÄLR IQ, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. 

 

1. About VÄLR IQ 

VÄLR IQ is a fitness tracking application designed to help users record, organize, and review information related to workouts, exercises, personal records, fitness habits, nutrition, meals, hydration, body weight, goals, progress, and other fitness-related activities. 

 

The App may include features such as workout and exercise logging, routines, cardio and core tracking, personal records, workout history, nutrition and food logging, meal tracking, water and weight logging, habit tracking, goals, streaks, badges, experience points, levels, analytics, insights, health data integrations, profile customization, and other current or future features. 

 

VÄLR IQ is intended as a personal tracking and informational tool. It is not a medical device and does not provide medical advice, diagnosis, treatment, or professional healthcare services. 

 

2. Acceptance of These Terms 

By downloading, installing, accessing, or using VÄLR IQ, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. 

 

If you use VÄLR IQ through the Apple App Store or Google Play Store, your use of the App may also be subject to the applicable terms, policies, and agreements of Apple Inc. or Google LLC. 

If you do not agree to these Terms, you must discontinue use of the App. 

 

3. Eligibility 

You must be legally capable of agreeing to these Terms under the laws applicable to you. 

If you are under the age at which you can independently consent to these Terms in your jurisdiction, you may use the App only with the permission and supervision of a parent or legal guardian. 

 

The App is not directed toward children under the age of 13. 

 

4. Fitness, Exercise, Health, and Medical Disclaimer 

VÄLR IQ provides tools for recording, organizing, displaying, and analyzing fitness, exercise, nutrition, habit, and related information. The App is provided for general informational and personal tracking purposes only. 

 

VÄLR IQ does not provide medical advice, medical diagnosis, medical treatment, physical therapy, nutritional therapy, or other professional healthcare services. Nothing provided through the App should be interpreted as a substitute for advice from a qualified physician, registered dietitian, physical therapist, certified fitness professional, or other qualified healthcare provider. 

 

You should consult an appropriate healthcare professional before beginning or significantly changing an exercise, fitness, nutrition, or wellness program, particularly if you have a medical condition, injury, symptoms, physical limitations, or other health concerns. 

 

Exercise and physical activity involve inherent risks, including the risk of injury, illness, disability, or death. You are solely responsible for determining whether any exercise, workout, activity, routine, weight, repetition range, duration, intensity, nutrition practice, or other activity is appropriate for you. 

 

You voluntarily assume the risks associated with exercise and physical activity and are responsible for exercising safely, using proper technique, selecting appropriate weights and intensity levels, using appropriate equipment, and stopping activity when necessary. 

 

If you experience pain, dizziness, shortness of breath, faintness, or other concerning symptoms, stop exercising and seek appropriate medical attention. 

 

5. Nutrition and Food Information 

VÄLR IQ may allow users to search for, enter, save, calculate, estimate, or track foods, meals, calories, macronutrients, micronutrients, serving sizes, hydration, body weight, and other nutrition-related information. 

 

Nutrition information may originate from user input, third-party databases, publicly available information, product information, estimates, calculations, or other sources. Although we may take reasonable steps to improve the usefulness and accuracy of such information, we do not guarantee that nutrition information is complete, accurate, current, or appropriate for any particular individual. 

 

Serving sizes, ingredients, preparation methods, manufacturer changes, restaurant recipes, database errors, and user input may cause actual nutritional values to differ from values displayed in the App. 

 

You are responsible for independently verifying nutrition information when accuracy is important, including in connection with allergies, intolerances, medical conditions, dietary restrictions, medications, or other health-related considerations. 

 

VÄLR IQ is not a substitute for professional medical or dietary advice. 

 

6. User-Entered Information and Accuracy 

The usefulness and accuracy of VÄLR IQ may depend on information entered or selected by you. This may include exercises, sets, repetitions, weight, duration, distance, food intake, nutrition information, water intake, body weight, habits, goals, profile information, and other data. 

 

You are responsible for the accuracy and appropriateness of information you enter into the App. 

 

Analytics, calculations, achievements, experience points, levels, streaks, personal records, insights, estimates, and other outputs may be based on user-entered information and may therefore be inaccurate if the underlying information is incomplete or incorrect. 

 

We do not guarantee the accuracy, completeness, reliability, or suitability of calculations, analytics, recommendations, estimates, or other information displayed by the App. 

 

7. Health and Third-Party Data Integrations 

VÄLR IQ may integrate with third-party health, fitness, device, or platform services, including Apple Health or similar services that may be supported in the future. 

 

The availability and operation of these integrations may depend on your device, operating system, permissions, third-party services, and other factors outside our control. 

 

You control whether to grant applicable permissions where supported. You are responsible for reviewing and managing permissions through your device and platform settings. 

 

We do not guarantee that third-party health or fitness data will always be available, accurate, complete, synchronized, or free from interruption or duplication. 

 

Third-party services are governed by their own terms, policies, and privacy practices. 

 

8. Local Data Storage and Risk of Data Loss 

Certain VÄLR IQ data may be stored locally on your device rather than on servers operated by us. 

 

Depending on the features available to you, deleting the App, clearing application data, losing or damaging your device, resetting your device, changing devices, operating system changes, software errors, storage corruption, or other circumstances may result in permanent loss of your data. 

 

Unless a specific backup, export, synchronization, or cloud-storage feature is expressly provided, you should not assume that your data is backed up or recoverable. 

 

You are responsible for maintaining any backups or exports made available through the App. 

 

We are not responsible for loss, corruption, deletion, or inability to recover locally stored data to the maximum extent permitted by applicable law. 

 

9. Free Features, Usage Limits, and Rewarded Advertising 

VÄLR IQ may offer free and paid features. 

 

Free users may be subject to limits on logging, features, functionality, access, frequency of use, or other aspects of the App. These limits may change over time. 

 

The App may allow eligible users to view rewarded advertisements in exchange for temporary access to additional logging capacity, functionality, benefits, or other in-app features. The availability of rewarded advertisements is not guaranteed and may depend on factors such as geographic location, device, network connection, advertising inventory, eligibility, and third-party advertising services. 

 

We may modify, add, remove, increase, decrease, suspend, or discontinue free-tier limits, rewarded-ad benefits, eligibility requirements, or other free features at any time, subject to applicable law. 

 

Viewing an advertisement does not entitle you to monetary compensation or any benefit other than the specific in-app benefit expressly offered at that time. 

 

10. VÄLR IQ Pro and Paid Subscriptions 

VÄLR IQ may offer paid subscriptions or premium features, including VÄLR IQ Pro. 

 

Subscription pricing, duration, available features, introductory offers, trials, and other terms will be displayed through the applicable platform or purchase interface before purchase. 

 

Subscriptions purchased through the Apple App Store are processed and billed by Apple. Subscriptions purchased through Google Play are processed and billed by Google. We do not directly control the payment processing, billing systems, refund processes, or subscription management systems of Apple or Google. 

 

Unless otherwise stated by the applicable platform, subscriptions may automatically renew unless canceled before the applicable renewal deadline. You are responsible for managing or canceling your subscription through your Apple App Store or Google Play account settings, as applicable. 

 

Refund requests are generally subject to the policies and processes of the platform through which the purchase was made. 

 

We may use third-party services, including RevenueCat, to manage subscription status, purchase validation, entitlements, offerings, and related functionality. 

 

Access to paid features may depend on accurate communication among the App, the applicable app marketplace, RevenueCat, your device, and other services. Temporary delays or interruptions may occur. 

 

Except where required by law or applicable platform rules, purchasing a subscription does not guarantee that every current feature will remain unchanged or available indefinitely. 

 

11. Experience Points, Levels, Streaks, Badges, and Virtual Achievements 

VÄLR IQ may include experience points ("XP"), account levels, exercise levels, habit levels, streaks, badges, achievements, titles, progress bars, statistics, rankings, or other virtual progress features. 

 

These features are provided for entertainment, motivation, organization, and personal tracking purposes only. 

 

XP, levels, streaks, badges, titles, achievements, and other virtual items or indicators: 

• have no cash or monetary value; 

• cannot be redeemed for money unless expressly stated otherwise; 

• do not represent ownership of any financial asset or property right; 

• may be recalculated, modified, corrected, reset, removed, or discontinued when reasonably necessary for technical, balancing, integrity, or product-development purposes; and 

• may be affected by changes to the App, data loss, software errors, user actions, or other circumstances. 

 

We do not guarantee the permanent availability or preservation of virtual progress features. 

 

12. Profile Information, Images, and User Content 

The App may allow you to enter a profile name, upload a profile picture, create custom exercises, habits, routines, meals, foods, goals, or other user-generated information or content. 

 

You retain any rights you have in content you create or upload. 

 

You are responsible for ensuring that you have the right to use any content you provide through the App and that such content does not violate applicable law or the rights of another person. 

 

You may not use the App to store, upload, or distribute unlawful, infringing, abusive, fraudulent, or otherwise prohibited content. 

 

Where user content is stored only locally on your device, we may not have access to or control over that content. 

 

13. Acceptable Use 

You agree not to: 

• use VÄLR IQ for unlawful or fraudulent purposes; 

• attempt to interfere with, disrupt, damage, reverse engineer, exploit, or gain unauthorized access to the App or related systems, except to the extent such restriction is prohibited by applicable law; 

• circumvent subscription requirements, free-tier limits, advertising systems, purchase validation, or other access controls; 

• manipulate App functionality, XP, levels, achievements, subscriptions, advertising rewards, or other systems through unauthorized means; 

• introduce malicious code, viruses, or other harmful technology; 

• use automated systems to abuse or overload the App or associated services; or 

• use the App in a way that infringes the rights of others. 

 

We may restrict or terminate access to the App where reasonably necessary to address misuse, fraud, security concerns, legal requirements, or violations of these Terms. 

 

14. Intellectual Property 

VÄLR IQ, including its software, source code, design, graphics, logos, branding, user interface, text, organization, features, and other original content, is owned by or licensed to the developer of VÄLR IQ and is protected by applicable intellectual property laws. 

 

Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App for your personal, non-commercial use. 

 

These Terms do not transfer ownership of VÄLR IQ or any associated intellectual property to you. 

 

You may not copy, reproduce, distribute, sell, license, modify, create derivative works from, or commercially exploit the App or its content except as expressly permitted by law or with prior written permission. 

 

15. Third-Party Services 

VÄLR IQ may rely on or interact with third-party products and services, including, where applicable, Apple, Google, RevenueCat, Google AdMob, Apple Health, app marketplaces, operating systems, advertising providers, data providers, and other technology services. 

 

We do not control third-party services and are not responsible for their availability, performance, accuracy, security, policies, or practices. 

 

Your use of third-party services may be governed by separate agreements between you and those third parties. 

 

The inclusion or use of a third-party service does not constitute a guarantee or warranty regarding that service. 

 

16. App Availability, Updates, and Changes 

We may update, modify, improve, add, remove, suspend, or discontinue features or functionality of VÄLR IQ at any time. 

 

The availability of features may vary based on device, operating system, geographic location, subscription status, app version, platform, technical limitations, or other factors. 

 

We do not guarantee that the App, any specific feature, or any third-party integration will always be available, uninterrupted, secure, or error-free. 

 

Updates may be required to continue using certain features. 

 

We may change the distinction between free and paid features, subject to applicable law and platform requirements. 

 

17. Disclaimer of Warranties 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VÄLR IQ IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. 

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, AND FITNESS FOR ANY PARTICULAR FITNESS, HEALTH, NUTRITION, OR PERFORMANCE GOAL. 

 

WE DO NOT WARRANT THAT: 

• THE APP WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE; 

• ALL INFORMATION, CALCULATIONS, NUTRITION DATA, ANALYTICS, INSIGHTS, PERSONAL RECORDS, OR OTHER OUTPUTS WILL BE ACCURATE OR COMPLETE; 

• USE OF THE APP WILL PRODUCE ANY PARTICULAR FITNESS, HEALTH, STRENGTH, BODY COMPOSITION, WEIGHT, NUTRITION, OR PERFORMANCE RESULT; OR 

• DATA WILL NEVER BE LOST, CORRUPTED, OR DELETED. 

 

Some jurisdictions do not allow certain warranty disclaimers, so some of the above limitations may not apply to you. 

 

18. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VÄLR IQ AND ITS DEVELOPER, OWNER, AFFILIATES, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP. 

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES OR LOSSES RELATED TO: 

• PERSONAL INJURY OR PHYSICAL ACTIVITY; 

• RELIANCE ON FITNESS, HEALTH, OR NUTRITION INFORMATION; 

• LOSS OR CORRUPTION OF DATA; 

• LOST PROFITS OR REVENUE; 

• DEVICE DAMAGE; 

• SERVICE INTERRUPTIONS; 

• THIRD-PARTY SERVICES; 

• SUBSCRIPTION ACCESS INTERRUPTIONS; OR 

• UNAUTHORIZED ACCESS, TO THE EXTENT PERMITTED BY LAW. 

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY FOR USE OF VÄLR IQ DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR TEN U.S. DOLLARS (US $10.00). 

 

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. 

 

19. Indemnification 

To the extent permitted by applicable law, you agree to indemnify and hold harmless VÄLR IQ and its developer, owner, affiliates, representatives, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the App, violation of these Terms, or infringement of another person's rights. 

 

20. Suspension and Termination 

You may stop using VÄLR IQ at any time. 

 

We may suspend, restrict, or terminate access to the App or particular features if reasonably necessary because of a violation of these Terms, fraud, abuse, security concerns, legal requirements, technical necessity, or discontinuation of the App. 

 

Termination does not automatically cancel an active subscription. Subscriptions must be managed through the platform through which they were purchased unless otherwise required by applicable law. 

 

Sections of these Terms that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, and dispute-related provisions. 

 

21. Apple App Store Terms 

If you download or use VÄLR IQ through the Apple App Store, you acknowledge that: 

• these Terms are between you and the developer of VÄLR IQ, not Apple Inc.; 

• Apple is not responsible for the App or its content; 

• Apple has no obligation to provide maintenance or support services for the App, except as required by applicable law; 

• your use of the App must comply with applicable Apple terms and policies; 

• Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple's applicable requirements and may have the right to enforce applicable provisions against you; and 

• your use of the App may also be subject to Apple's applicable Standard End User License Agreement or other applicable Apple terms. 

 

Nothing in these Terms is intended to conflict with mandatory requirements imposed by Apple. 

 

22. Google Play Terms 

If you download or use VÄLR IQ through Google Play, you acknowledge that: 

• these Terms are between you and the developer of VÄLR IQ, not Google LLC; 

• Google is not responsible for the App or its content except as expressly required under applicable law or Google's own terms; 

• your use of the App must comply with applicable Google Play terms and policies; and 

• purchases, subscriptions, refunds, billing, and other marketplace-related matters may also be subject to applicable Google Play terms. 

 

Nothing in these Terms is intended to conflict with mandatory requirements imposed by Google. 

 

23. Privacy 

Your use of VÄLR IQ is also subject to the VÄLR IQ Privacy Policy, which describes how information is collected, used, stored, and shared in connection with the App. 

 

If there is a conflict between these Terms and the Privacy Policy regarding the treatment of personal information, the Privacy Policy will control with respect to that subject matter. 

 

24. Changes to These Terms 

We may update these Terms from time to time to reflect changes to the App, our business practices, legal requirements, third-party services, or other circumstances. 

 

When these Terms are updated, the effective date will be revised. 

 

Where required by applicable law, we will provide additional notice or obtain consent before materially revised Terms become effective. 

 

Your continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law. 

 

25. Governing Law 

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law principles, except where applicable consumer protection laws or other mandatory laws require otherwise. 

 

Any dispute arising from or relating to these Terms or VÄLR IQ will be subject to the jurisdiction of courts of competent jurisdiction in Ohio, except where applicable law provides you with the right to bring a claim in another jurisdiction. 

 

26. Severability 

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect. 

 

27. No Waiver 

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right. 

 

28. Entire Agreement 

These Terms, together with the VÄLR IQ Privacy Policy and any additional terms expressly presented in connection with a particular feature or purchase, constitute the agreement between you and us regarding your use of VÄLR IQ, subject to any applicable mandatory terms of Apple, Google, or another platform provider.
